1932. NEW ZEALAND.

DEPARTMENT OF LABOUR (REPORT OF THE).

Presented to both Houses of the General Assembly by Command of His Excellency.

The Acting-Secretary, Department of Labour, to the Hon. the Minister op Labour. Sir,' — Department of Labour, Wellington, 28th July, 1932. I have the honour to present herewith the forty-first annual report of this Department, for the information of His Excellency the Governor-General, and to be laid before Parliament, in compliance with the Labour Department Act, 1908, and the Factories Act, 1921-22. The report covers the financial year Ist April, 1931, to 31st March, 1932. Owing to the continued need for economy, the report has again been made as brief as possible. I have, &c., Henry E. UNEMPLOYMENT. On the 30th March, 1931, there were 38,028 applicants registered at the Department's employment offices throughout the Dominion. With slight fluctuations the number gradually increased to 51,408 on the sth October, 1931, thereafter decreasing steadily until the 29th February, 1932, when it stood at 44,107. The number on the Department's registers on the 28th March, 1932, was 45,383. This number is 7,355 in excess of the number on the registers at the close of the previous year. (Note. — Since the end of the year —viz., March last —the number of registered unemployed has continued to increase, the maximum figure up to the present being 55,203 on the 25th July, 1932 —i.e., 3,795 in excess of the peak figure for last year.) During the year 18,328 men were placed in employment, 3,403 on Government works, 12,171 in private employment, inclusive of those placed under Schemes 4 and 8, 679 with local bodies (apart from those employed on the Unemployment Board's No. 5 Scheme) and 2,075 in camps under the Unemployment Board's schemes. In addition, 325 were assisted by advances of railway fares. (Figures for the previous year were : 12,586 Government works, 9,245 local bodies, 7,320 private employment, 1,072 on temporary work immediately following the Hawke's Bay earthquake ; total, 30,223.) Of the 45,383 men on the Department's registers at the 28th March, 29,182 were employed under No. 5 Scheme, which then provided for three weeks' (out of every four weeks) temporary employment up to four days each week according to each man's circumstances. This figure does not, however, give an accurate idea of the number of unemployed who were assisted under the scheme, the maximum number securing relief during the year being 37,356 on the 21st December, 1931, when the total number of unemployed on the register was 45,524. The men employed under No. 5 Scheme are not regarded as " placements," and are not therefore included in the figure 18,328 {supra).

Details as to the number of men employed under the various schemes of the Unemployment Board may be obtained from the annual report of the Commissioner of Unemployment. The work of registering the large number of unemployed and of placing the men in employment under the various schemes of the Board has again been given precedence over the general work of the Department, but the investigation of complaints of alleged breaches of Acts, awards, &c., the inspection of scaffolding, &c., and the reverification of weights, measures, &c., under the Weights and Measures Act have been carried on to the fullest possible extent in the circumstances.

FACTORIES ACT.

The figures as to the number of factories and workers employed therein do not purport to coincide with those of the Government Statistician (Census of Industrial Manufactures); as his returns, which are drawn up purely for statisticial purposes, do not cover various small establishments that are included as factories under the Factories Act. The decrease of 14,445 in the number of factory workers is spread fairly evenly over all trades, but approximately 75 per cent, of this figure represents the reduction in the number of male workers. It might be explained that the above figures are those ascertained at registration-time (April in each year), except that in order to include factories in seasonal industries which might be closed in April any new establishments opened during the year are added ; the figures shown for 1931-32 therefore chiefly represent the numbers in April, 1931. Accidents. As mentioned last year, in order that the accident statistics may be comparable with the statistics of other countries, as urged by the International Conference of Labour Statisticians in 1923, the figures cover the calendar year instead of the financial year. The total number of reported accidents to workers in factories is 2,249 (2,172 males and 77 females). Of the total number, 44 of the accidents occurred to workers under sixteen years of age, 375 to those between sixteen and twenty, and the remaining 1,830 to those above that age. Of the 5 fatal accidents, 1 was caused by or was due to machinery. Of the total accidents, 358 were caused by or were due to machinery. The other principal causes of accidents were found to be as follows : Falls of persons (from stairs, ladders, platforms, &c.), 206 ; stepping on or striking against fixed objects, 130 ; faulty handling of tools, 636 ; handling of other objects (viz., objects dropped or tipped over, objects falling, or strain due to handling), 548 ; handling of poisonous, hot, and corrosive substances, 84 ; others (miscellaneous), 287 : total, 2,249. Disability caused : Temporary disability, 2,166 ; permanent partial disability, 78 ; fatalities, 5. The following particulars are given of the fatal accidents that occurred during the year : — (1) A worker in a freezing-works removed the lid of a digester which had been working and an explosion occurred. The worker was severely scalded and died from shock. There is no definite evidence of the cause of the explosion, but the foreman in charge was of the opinion that the worker removed the lid quickly and the resultant rush of cold air caused an eruption of the boiling tallow. (2) A plumber employed in a freezing-works was working on a ladder about 12 ft. from the ground, when he overbalanced and fell on to a concrete floor, fracturing his skull. (3) A scutcher in a twine-factory reached over the shaft of the machine he was working to test the tightness of the bearings and a frayed portion of his sleeve caught in the shaft. He managed to avoid being drawn round the shaft, but his clothes were torn from him and he died a week later from septic pneumonia following an injury to his chest. (4) A sailmaker was standing on a sewing-bench, when he slipped and fell through a window to the street below, a distance of over 50 ft. No reason could be given for deceased's being on the bench. (5) A carpenter at a freezing-works was working in the fitting-shop when a cylinder containing liquid ammonia burst and he was asphyxiated. The other workers in the room managed to escape into the open air, but the deceased apparently lost his sense of direction and went into an adjoining storeroom where he was overcome by the fumes.

Inspections, etc. Systematic inspection has not been carried out this year, but where necessary, on account of complaints, &c., visits were paid. Prosecutions numbered 14, in 12 of which convictions were obtained ; the fines totalled £29 ; no case calls for comment. Complaints were received respecting 210 alleged breaches of the Act, resulting in 8 prosecutions and 150 warnings. In 40 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Six prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. There were 405 requisitions served to comply with various requirements of the Act, such as for limewashing ; safeguards for workers employed on machinery, &c. ; sanitary conveniences ; fireescapes ; renovations and structural alterations; heating-appliances; ventilation; first-aid appliances ; and dining-rooms in the case of establishments employing over six women and girls and boys under sixteen.

SHOPS AND OFFICES ACT. The records show 26,467 shops throughout New Zealand, of which 13,849 (approximately one-half) were carried on without assistants. In the shops with assistants there were employed 19,442 males and 18,289 females. For reasons of economy systematic inspection has not been carried out this year. Prosecutions numbered 141, in which 123 convictions were obtained ; fines, £175 10s. Complaints were received respecting 513 alleged breaches of the Act, resulting in 42 prosecutions and 286 warnings. In 160 ca,ses investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Ninety-nine prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. Forty-seven requisitions were served on occupiers of shops to comply with various requirements of the Act, such as for sanitary conveniences, heating-appliances, fire-escapes, and ventilation. Registration of Industrial Associations and Unions. The usual statutory return (to the 31st December, 1931) of the associations and unions registered under the Act, with their membership at that date, is published herewith as an appendix. Comparison with the previous year shows that the total number of workers' unions has decreased by eleven (to 405) and the total membership has decreased by 10,990 (from 101,516 to 90,526). Inspections, etc. During the year 3,203 complaints of alleged breaches of the Act and of awards and industrial agreements, &c., were received, but it was found on investigation that in 813 cases no breach had been committed ; in 185 cases proceedings were taken, and in 1,892 warnings were given. No action was considered necessary in the remaining cases. Apart from the complaints mentioned above, a large proportion of the inspections of factories, shops, &c., included an inspection to ascertain whether the awards and agreements were being complied with in respect of wages, overtime, &c., and, as a result of these inspections, 34 prosecutions were taken and warnings were given in other cases. Of the 219 prosecutions, 206 were against employers and 13 against workers ; 166 convictions were recorded, 156 against employers and 10 against workers. Total penalties, £253 7s. Amendments to Act. During the year legislation was passed (vide Part II of the Finance Act, 1931) giving the Court of Arbitration power by general order to amend the provisions of awards, agreements, and apprenticeship orders in so far as such provisions determined the rates of remuneration of workers, with the proviso that any such general order would not apply to any contract of apprenticeship in force at the taking-effect of such general order. In exercising the powers mentioned the Court of Arbitration was required to have regard to the economic and financial conditions affecting trade and industry in New Zealand. In pursuance of this legislation the Court on the 29th May, 1931, issued a general order reducing the rates of remuneration fixed by awards, agreements, and apprenticeship orders by 10 per cent. Although this reduction was of considerable assistance to employers, it was urged on their behalf that industry was being unduly hampered by various restrictive conditions imposed by awards and agreements in connection with the employment of labour. With a view to assisting industry in this respect during the present economic crisis, a Bill was introduced to amend the conciliation and arbitration procedure under the Industrial Conciliation and Arbitration Act and to provide for the immediate review by the employers and workers of all awards and agreements in respect of wages and other conditions of employment. It was felt by the Government that the prevailing conditions in trade and industry were such that the full co-operation of employers and workers was essential if the economic distress arising out of the depression was to be alleviated in any way, and it was considered that the adjustment of wages and other conditions of employment with that object in view could be more satisfactorily arranged in the circumstances by agreement between the parties than by arbitrary fixation. For this reason the Bill provided for what might be termed " compulsorv conciliation and optional arbitration,' a radical departure from the old principles of conciliation and arbitration which had been in operation for over thirty years and under which, if conciliation failed, arbitration was compulsory. The Bill was passed by Parliament shortly after the close of the year, but in view of the importance of the measure a summary of its main provisions is being given in this report. Industrial Conciliation and Arbitration Amendment Act, 1932. Section 3: The maximum number of assessors on each side in conciliation proceedings is increased by one —from three to four in local disputes and from six to seven in " Dominion " disputes — i.e., disputes affecting more than one industrial district. Section 5 : If a settlement of a dispute is arrived at by the Conciliation Council the terms of the settlement shall be reduced to writing, and signed by all the assessors. The document is then filed and operates as an industrial agreement in the same way as if it were an industrial agreement signed by all the parties to the dispute. Section 6 : This gives any party to the dispute power to apply to the Court for exemption from the operation of an agreement filed under the preceding section. Section 7 : This section provides that a dispute can be referred to the Court only in cases where the specified majority of assessors representative of both parties agree that it shall be so referred. It also provides that if within thirty days after the first meeting of the Conciliation Council the dispute is not settled or referred to the Court of Arbitration or adjourned for further consideration by the parties for a period of not more than fourteen days or in the last-mentioned case is not settled or referred to the Court within five days after the resumption of proceedings the Conciliation Commissioner shall notify the Clerk of Awards accordingly, and at the expiration of one month from the date of the Commissioner's notification any award or industrial agreement in force in that industry binding on the parties shall be deemed to be cancelled, and shall thereupon cease to be in force. If, however, the dispute relates to an industry in which female workers are employed, and it is not settled in the Conciliation Council or referred to the Court for settlement, any organization representing the female workers concerned may have the minimum rates of wages that may be paid to such female workers fixed by the Court of Arbitration.

Section 9 : This provides for the review of existing awards and agreements in accordance with the new procedure, where such awards and agreements have been in force for not less than six months and have an unexpired term of not less than three months. Sections 11 and 12 : These sections provide for the payment of workers at piece rates and for the setting-up of Industrial Committees for the promotion of the harmonious working of awards and industrial agreements. Section 13 : This provides for exclusion from the operation of awards and industrial agreements of relief works under the Unemployment Act, 1930, and of the workers employed on such works. Industrial Disturbances during the Yeak. There were in all twenty-seven industrial disturbances during the year. The following is a summary of the larger disturbances : — Coal-miners (Denniston). —The union demanded that all men working in the power-house should be paid a full day s pay whether working a full shift or not. After negotiations work was resumed, the management reserving the right to work the power-house to suit the requirements of the company, but undertaking to endeavour to arrange for the men to work an eight-hour shift. The mine, which was employing 485 men, was idle for seventeen days. Coal-miners, Wilsons Collieries (Hilcurangi). —The company refused to make up the wages of three men to the minimum amount fixed by the agreement on the ground that they should have been able to earn the minimum rate and that it was their own fault that they did not do so : and the other miners thereupon ceased work. Subsequently the company paid the amount of wages in dispute, and the mine was taken over by the men with a view to its being worked on a co-operative basis. The mine, which employed 178 men, was idle for twenty-one days. Coal-miners (Dobson). —The company gave notice of dismissal to the 300 men employed, and after expiry of the notice offered employment to only a certain number of them. The men demanded that the available work be shared, but ultimately work was resumed on the company's terms. The mine was closed down for approximately two months.

LABOUR DISPUTES INVESTIGATION ACT, 1913. The following information shows the extent to which the workers have preferred the method provided by the above Act for the settlement of their disputes to the procedure to be followed if they register under the Industrial Conciliation and Arbitration Act.

Arising out of the disputes filed under the Act since its inception to date, only six ballots have been necessary, and in none of these cases did a strike take place in pursuance of such a ballot. There were on 31st March, 1932, nine agreements in force under this Act, in the following industries :— Coal-mining. Marine engineers and shift engineers in freezing-works and power-houses. Gas-manufacture (including clerical and showroom employees). Glass-manufacture. Tramway and omnibus services (including coach and car building). Managers in dairy factories. APPRENTICES ACT. This Act, which was passed in 1923, places the regulation of apprenticeships in the control of the Court of Arbitration. Jt also provides for the establishment of committees representative of employers and workers ; these have such powers as may be delegated to them by the Court. The Committees, of which there are 101 functioning, are chiefly to be found in the main towns, and there is usually one for each industry. The Department has again made available to committees the services of some of its experienced officers, who undertake inquiry work and in many cases act in a secretarial capacity. These officers made 1,620 inspections under this Act during 1931-32, the inspections being carried out chiefly in the course of ordinary inspection and investigation work and while visiting factories, &c., in connection with other duties.

Complaints were received regarding 486 alleged breaches of the Act, while 118 other breaches were discovered by the Department's Inspectors, 388 warnings being issued. There were 41 prosecutions during the year for various breaches of the Act and the orders made thereunder, convictions being entered in 22 of the cases, and penalties amounting to £35 ss. being imposed. Of the prosecutions, 23 were against employers and 18 against apprentices. The following table gives the approximate number of apprentices in the trades to which the Act applies. Owing to the great difficulty that was being experienced by employers in finding employment for their apprentices during the present economic crisis, provision was made in section 56 of the Finance Act, 1932, giving Magistrates power, on application by any party concerned, to amend, suspend, or cancel any contract of apprenticeship in force at the date of the passing of the Act. Before cancelling any contract, however, the Magistrate is required to be satisfied that, owing to the economic conditions affecting the industry concerned or the particular business of the employer, the employer cannot reasonably be expected to continue to carry out the terms of the contract, but in the event of his ordering cancellation of the contract he may, if he thinks fit, award compensation to the apprentice. Numbers of applications have already been made under this legislation, relief being granted in the great majority of cases by amending the contracts with a view to rationing the work available or by suspending the contracts for certain periods. In very few cases has cancellation of the contracts been ordered. ARREARS OP WAGES. Amounts totalling £4,695 18s. 6d. were collected by the Department's officers on behalf of workers who had been underpaid the wages prescribed by awards and the various Acts, while further amounts of such arrears, totalling £2,584 195., were paid by employers, at the instance of the Inspectors, directly to the workers concerned : Total, £7,280 17s. 6d. WORKERS' COMPENSATION ACT. The following cases have been heard and determined by the Court of Arbitration during the last six years: 1926,60; 1927,99; 1928,99; 1929,101; 1930,123; 1931,175. A summary of the more important cases is contained in New Zealand Workers' Compensation Cases," which is published annually by the Department, AGRICULTURAL LABOURERS' ACCOMMODATION ACT (ACCOMMODATION FOR FLAXMILL AND SAWMILL WORKERS, ETC.). A total of seven inspections were made under this Act at sawmills, flax-mills, &c., and five owners were required to carry out improvements to buildings, to provide new or to improve existing conveniences, and to provide first-aid outfits and bathing-facilities.

SHEARERS' ACCOMMODATION ACT. The Inspectors of the Agriculture Department again carried out all necessary inspections under this Act, and it was found that on the whole the accommodation provided was satisfactory. In a number of cases, however, particularly as regards the older buildings, it was found that alterations and improvements were needed, but in view of the present financial stringency owners were not called on to incur expenditure for this purpose, unless, of course, the accommodation was distinctly unfit or insanitary. No prosecutions were taken and no complaints were received regarding the nature of the accommodation provided. SCAFFOLDING AND EXCAVATION ACT. During the year 3,053 notices of intention to erect buildings and scaffoldings and to commence excavations were received, and 13,508 inspections were made. There was one prosecution, a conviction being recorded ; fine £2 10s. The number of accidents that occurred during the year ending 31st December, 1931, is 201 (of which 7 were fatal). Of the 201 accidents, 187 were of a minor nature. It should be mentioned that the total includes not only accidents to workers on scaffolding or in connection with gear or excavations, but also all other accidents occurring in connection with building operations. Taking into consideration the hazardous nature of the work and the large number of workers involved, the number of accidents due to falls from scaffolds, ladders, or roofs is small —viz., 18. The numbers according to occupations are: Labourers, 81; carpenters, 63; painters, 3; steelworkers, 4; plasterers, 7; bricklayers, 3 ; plumbers, 3 ; unclassified, 37. The following are particulars of the fatal accidents reported : — (1) A labourer was engaged in trimming the walls of a sewer tunnel preparatory to its being lined with concrete when he stepped back to avoid a fall of sandstone ; he tripped over the hose attached to the drill and struck his head on the tram-rail. (2) A rigger was being hoisted on a platform to do some work on a tower used for distributing concrete to various parts of a building under construction when the galvanized steel rope supporting the platform parted, and he fell a distance of 113 ft. to the ground. No explanation could be given of the cause of the break. The rope was one with an estimated breaking-strain of over 6 tons, and the load at the time of the accident was less than 1 ton. (3) A master plumber was inspecting a roof which had been painted with graphite paint when he slipped and fell to the ground sustaining fatal head injuries. (4) A labourer was engaged in timbering the sides of a sewerage trench 17 ft. deep, when one side of the trench collapsed. The worker was buried beneath the spoil and died of suffocation. (5) A worker was employed in the demolition of a building and was removing bricks from a wall to free the end of a girder when he overbalanced and fell a distance of 40 ft. to the ground. (6) A carpenter was engaged on a scaffold on the second story of a building, when he was thrown off his balance by a sudden gust of wind and fell beneath the guard rail to the floor, a distance of approximately 10 ft. He died some hours later from shock following head injuries. (7) A labourer who was in charge of a lift used for hoisting trucks of soil out of a 60 ft. shaft apparently in a moment of forgetfulness pushed an empty truck over the edge of the shaft while the lift was at the bottom. The worker fell with the truck sustaining fatal injuries. SERVANTS' REGISTRY OFFICES ACT. There are eighty-one offices registered in New Zealand, all of which appear to be satisfactorily conducted. RENT RESTRICTION. There were 218 applications from tenants for inquiry (previous year, 120). From the Ist May, 1928, the Rent Restriction Continuance Act, 1927, provided (1) that the standard rent shall be determined on the basis of 7 per cent, on the capital value of the dwellinghouse as at the date of such determination (instead of on the 1914 value), exclusive of rates, insurance, repairs, and depreciation (as before) ; (2) that the Act shall cease to operate except where, on the application of the tenant, a Magistrate otherwise orders ; in deciding the question the Magistrate shall have regard to the greater hardship that may be caused to either party concerned. Subject to the following paragraph, the provisions do not apply to houses first let after the 9th November, 1920. By the Rent Restriction Extension Act, 1931 (passed 31st July, 1931) the provisions were further continued until the Ist August, 1932, and were extended to cover dwellinghouses_ in the Hawke's Bay earthquake area let on the 3rd February, 1931 (the date of the ear-thquake) or since that date at a rental not exceeding £104 per annum. By section 68 of the Finance Act, 1932, the legislation was further continued until the 31st October, 1932, when it will expire unless further extended. FOOTWEAR REGULATION ACT. There were 1,878 inspections made throughout the Dominion under this Act, and stocks of footwear were carefully examined. The arrangement made with the Customs Department whereby all imported footwear is examined in the Customs-shed before release is still being continued. WEIGHTS AND MEASURES ACT. The regulations under the Act provide for the reverification of weights, measures, and weighing and measuring instruments in use for trade purposes. The net-weight and standard-weight provisions of the regulations also received attention,_ 1,052 visits of inspection being made. There were 22 prosecutions for various breaches under this Act, convictions being obtained in 21 cases and fines amounting to £50 10s. being imposed. The other case was withdrawn. Verification fees earned totalled £8,817 12s. (previous year, £8,935 6s. lid.) ; decrease 14rS lid. Special attention was paid during the year to the weight of bread. In one town, owing to the price-cutting methods adopted, several bakers were tempted to reduce the weight of loaves. Prompt measures were taken by the Department's Inspectors, and several prosecutions resulted. The regulations applying to the sale of coal, coke, and firewood provide that coal sold by retail must be in quantities of 1 cwt. or If cwts. (viz., twelve bags to the ton). Provision is made, however, for the sale of quantities less than 1 cwt. if sold and delivered to the purchaser on the premises of the seller. Representations were made that the prevention of the delivery of coal of! the seller's premises in less than 1 cwt. quantities was a distinct hardship at the present time, in view of the depressed conditions. Consequently, the regulations were amended early in the year to provide for the delivery of J cwt. quantities. Inspections have been made from time to time to ensure that the regulations were being complied with.

LEAD PROCESS REGULATIONS. These regulations were issued in 1925 to protect workers from the danger of lead poisoning in factories where lead paints are manufactured or prepared, and also in places where painting operations are carried on. No complaints regarding non-compliance with the regulations have been received during the year, and only one case of suspected lead poisoning was reported. The worker concerned was suspended from his employment for a fortnight. TAILORING TRADE REGULATIONS. These regulations were gazetted in 1925 to prevent the misuse of such expressions as " tailormade " and " hand-made " as applied to garments made to measure, some of which are made partly by machine process. A number of complaints were received during the year, but in only three instances was it found that a breach of the regulations had been committed. In one case the clothier concerned was advertising factory-made garments as " tailor-made " by means of hand-bills, and prompt action by the Inspector resulted in the discontinuance of the advertisement, before any appreciable number of the bills had been distributed. In the remaining two cases letters of warning were sent to the firms concerned who were describing, by means of show-cards in the windows, suits made under factory conditions as suits " tailored 1 to measure.
