His Excellency the Governor-General, and to be laid before Parliament, in compliance with the Labour Department Act, 1908, and the Factories Act, 1921-22. EMPLOYMENT AND UNEMPLOYMENT. Several sections of this report contain evidence of improved conditions. The table relating to the number of factory workers, also the returns of industrial union membership, indicate greater employment in industry. The matter will be dealt with fully in a separate document which it is intended to table by leave of the House concerning relief of unemployment and measures to promote employment, and generally the activities in connection with the Unemployment Fund (now Employment Promotion Fund).

The figures as to the number of factories and workers employed therein do not purport to coincide with those of the Government Statistician (annual statistics of factory production) as his returns, which are drawn up purely for statistical purposes, do not cover various small establishments that are included as factories under the Factories Act. It might be explained that the above figures are those ascertained at registration-time (April in each year), except that in order to include factories in seasonal industries which might be closed in April any new establishments opened during the year are added. The figures shown for 1935-36, therefore, chiefly represent- the numbers in April, 1935. Mention has been made in the last two years' reports of the improvement noticeable in several industries —viz., clothing and white working, boot-manufacturing, and sawmilling and other trades associated with the building industry; the increase in the number of factories registered during the year^ —viz., 534—is the greatest since 1925-26. Registration fees received during 1935-36 reflected the increases above noted, being about 7 per cent, greater than in the preceding year. In respect to the 1936-37 year the revenue received during the first quarter indicates that a further increase both in factories registered and in factory workers may be anticipated this year. The records of overtime retained by the Department refer only to extended hours in the case of women and boys, the prior approval of the Inspector being necessary. From such records it is ascertained that a considerable amount of overtime has again been worked, particularly in the clothing trades. The law limits the amount of overtime that may be worked to ninety hours in any year, with an additional thirty hours in 1 special cases. Many clothing-factories worked the full limit of overtime allowed. Accidents. In order that the accident statistics may be comparable with the statistics of other countries, as urged by the International Conference of Labour Statisticians in 1923, the figures cover the calendar year instead of the financial year. The total number of reported accidents to workers in factories is 2,636 (2,472 males and 164 females). Of the total number, 78 of the accidents occurred to workers under sixteen years of age, 610 to those between sixteen and twenty, and the remaining 1,948 to those above that age. Of the three fatal accidents one was caused by or was due to machinery. Of the total accidents, 486 were caused by or were due to machinery. The other principal causes of accidents were found to be as follows: Falls of persons (from stairs, ladders, platforms, &c.), 281; stepping on or striking against fixed objects, 109; faulty handling of tools, 705; handling of other objects—viz., objects dropped or tipped over, objects falling, or strain due to handling—7s4; handling of poisonous, hot, and corrosive substances, 114; others (miscellaneous), 187: total, 2,636. Disability caused: Temporary disability, 2,537; permanent partial disability, 96. Fatalities, 3. Information in respect of time lost in 2,511 cases shows that a total of 49,677 days were lost, or an average of 19-8 days for each worker. The total amount of compensation paid in the 2,603 cases in respect of which the details have been secured was £31,823 18s. 6d. The following particulars are given of the fatal accidents that occurred during the year:— A probationer apprentice in the electrical trade was lighting a blow-lamp in the repair shop when a small tin of methylated spirits in close proximity ignited causing severe burns which later proved fatal. Two employees at a brickworks were pushing a trolley on which was a large retort weighing approximately 8 cwt. when, owing to an unevenness in the surface of the ground, the trolley stopped and the retort over-balanced and fell back on one of the men inflicting fatal head injuries. A gas company employee who operated a conveyer electrically operated on an elevated track was leaning over the machine carrying out adjustments when he apparently struck his hand accidentally against the controller leaver. The machine ran back and his head was struck against an overhanging girder causing fatal injuries. Inspections, etc. During the year visits of inspection to the number of 9,263 -were made, and where possible wages-books were examined to see that the provisions of the Unemployment Act, 1930, and its amendments had been complied with in respect of the deduction of the emergency unemployment charge. Prosecutions numbered 59, in 52 of which convictions were obtained; the fines totalled £70. No case calls for comment.

Complaints were received respecting 440 alleged breaches of the Act, resulting in 35 prosecutions and 260 warnings, In 128 cases investigation showed that no breach had been committed, while in the remaining cases no action was considered necessary. Twenty-four prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. There were 270 requisitions served to comply with various requirements of the Act, such as for lime-washing; safeguards for workers employed on machinery, &c.; sanitary conveniences; fire-escapes; renovations and structural alterations; heating-appliances; ventilation; first-aid appliances; and dining-rooms in the case of establishments employing over six women and girls and boys under sixteen. Factory Hygiene and Welfare Work. Attention to welfare conditions for female workers has been given by the women Inspectors of Factories in the four chief centres, visits also being made to smaller towns. A special investigation commenced last year in collaboration with officers of the Health Department into the use of injurious solvents, particularly amylacetate in the millinery trade, was responsible for improved conditions for workers using these solvents. Two firms successfully employed chemists to improve the formulae of their solvents.

Boys and Girls in Factories. Certificates of Fitness issued to Boys and Girls under Sixteen Years of Age to Work in Factories.

It is worthy of note that the number of boys under sixteen years commencing work in factories during the year is the highest since 1929-30, and presents a contrast with the figures immediately following that date, while the number of girls commencing work during the year is again high. The total constitutes a record—viz., 2,990 —the previous highest number being 2,823 —viz., in 1929-30. SHOPS AND OFFICES ACT. The Department has no accurate record as to the number of shops and the number of assistants employed therein, but from the information available it is estimated that there were during the year 27,672 shops throughout New Zealand, of which 14,360 (approximately one-half| were carried on without assistants. In the shops with assistants there were employed 21,385 males and 20,113 females. During the year visits of inspection to the number of 14,016 were made, and where possible wages-books were examined to see that the provisions of the Unemployment Act, 1930, and its amendments had been complied with in respect of the deduction of the emergency unemployment charge. Prosecutions numbered 314; convictions were obtained in 221 cases. A number of cases were withdrawn; fines totalled £294 19s. Complaints were received respecting 727 alleged breaches of the Act, resulting in 93 prosecutions and 397 warnings. In 201 cases investigations showed that no breach had been committed, while in the remaining cases no action was considered necessary. Two hundred and twenty-one prosecutions were instituted for breaches which were discovered by Inspectors, and warnings were given in other cases, being either first offences or of a minor nature. Fifty-five requisitions were served on occupiers of shops to comply with various requirements of the Act, such as for sanitary conveniences, heating appliances, lunch-room or seating accommodation, ventilation, and partitions.

Industrial agreements made under section 28 of the principal Act .. 30 Industrial agreements made under section 5 of the Amendment Act of 1932 .. .. .. .. .. .. . . 6 Disputes where recommendations were substantially accepted or agreements reached and referred to the Court to make awards .. 69 Disputes where no settlement was arrived at .. .. 21 Section 7 (4) of the 1932 Amendment Act, now repealed, provided that where a settlement of the dispute had not been arrived at by the Council of Conciliation appointed for the hearing thereof every award or industrial agreement theretofore binding on the parties to the dispute in connection with the industry to which the dispute related ceased to be in force on the expiration of one month from the date of the Commissioner's notification to the Clerk of Awards that no settlement of the dispute was arrived at. Under this provision failure to reach a settlement in the 21 cases mentioned above resulted in the cancellation of 7 awards and industrial agreements, the principal cause of failure being the inability of the parties to agree on the wages to be paid. . Inspections, etc. During the year 2,854 complaints of alleged breaches of the Act and of awards and industrial agreements, &c., were received, but it was found on investigation that in 822 cases no breach had been committed. In 270 cases proceedings were taken, and in 1,582 warnings were given. No action was considered necessary in the remaining cases. Apart from the complaints mentioned above, a large proportion of the inspections of factories, shops, &c., included an inspection to ascertain whether the awards and agreements were being complied with in respect of wages, overtime, &c., and, as a result of these inspections, 87 prosecutions were taken and warnings were given in other cases. Of the 357 prosecutions, 310 were against employers and 47 against workers; 304 convictions were recorded, 262 against employers and 42 against workers. Total penalties, £551 ss. Registration of Industrial Associations and Unions. The usual statutory return (to the 31st December, 1935) of the associations and unions registered under the Act, with their membership at that date, is published herewith as an appendix. Comparison with the previous year shows that the total number of workers' unions has decreased by 6 (to 410) and the total membership has increased by 6,538 (from 74,391 to 80,929). Industrial Disturbances during the Year. There were in all twenty industrial disturbances during the year. In no case was it considered necessary to take proceedings. The following is a summary of the more serious stoppages:— Coal-miners, Wesiport.—The refusal of the management to appoint the union's nominee to a vacant position resulted in 278 miners in the Westport district ceasing work. As a result of a conference the men returned to work after thirteen days' absence. Gold-mine Employees, Waihi.—A dispute in regard to wages in the Waihi district came to a head in a strike after the formalities prescribed in the Labour Disputes Investigation Act, 1913, had been followed. Four industrial unions with 664 members were involved, the cessation lasting seven days and a half. An agreement giving increased remuneration was arrived at as a result of a conference convened by the Hon. the Minister of Labour. Gold-miners, Waiuta.—Demands for increased wages were made and the miners at the Big River Mine ceased work. Thereafter an agreement restoring previous cuts was entered into in respect of this mine. At the Blackwater Mines similar demands had not been conceded at the end of the year but no actual strike occurred. Coal-miners, Westland.—Two hundred and thirty miners ceased work as a protest against the dismissal of a worker for alleged disobedience. The case was referred to an arbitrator and work was resumed after five days. Boatbuilders, Auckland.—Desiring increased wages, about one hundred workers in the boat-building trade ceased work at Auckland. Their demands were substantially conceded, and they resumed work after twenty-two days. The terms and conditions agreed upon were referred to the Arbitration Court to be embodied in an award.

Labour Disputes Investigation Act, 1913. During the year eighteen agreements were filed pursuant to section 8 (1), the agreement in each case being reached without recourse to a conference under the Act or to a Labour Disputes Committee. These agreements were as follows:— Dairy-factory managers, Wellington Industrial District. Electric-power Board employees, Wanganui. Electrical workers, South Canterbury. Engine-drivers, firemen, pumpmen, &c., Westland State Coal-mines. Freezing-workers, Auckland. Freezing-works labourers, Masterton. Freezing-workers, North Canterbury. Freezing-workers, Otago. Freezing-workers, South Otago. Glassworkers, Auckland. Photo-engravers, Auckland. Photo-engravers, Wellington. Photo-engravers, Dunedin. Dairy-produce and cold-storage workers, Wellington. Tramway and omnibus employees, Auckland. Tramway workshop employees, Christchurch. In two cases short-dated agreements were made and renewed during the year. Arising out of the disputed filed under the Act since its inception to date, only nine ballots have been necessary, and in none of these cases did a strike take place in pursuance of such a ballot. There were on the 31st March, 1936, eighteen agreements in force under this Act in the following industries: — Clerical and show-room employees (Gas Co.). Dairy-factory managers. Electric-power Board employees. Electrical workers. Engine-drivers, firemen, pumpmen, &c. Freezing-workers. Glassworkers. Grocery trade managers in chain stores. Photo-engravers. Storage workers in dairy-produce and cold stores. Tramway and omnibus employees (including engineers and powerhouse employees). APPRENTICES ACT. This Act, which was passed in 1923, places the regulation of apprenticeships in the control of the Court of Arbitration. It also provides for the establishment of Committees representative of employers and workers; these have such powers as may be delegated to them by the Court. & The Committees, of which there are 95 functioning, are chiefly to be found in the main towns, and there is usually one for each industry. The Department has again made available to Committees the services of some of its experienced officers who undertake inquiry work and in many cases act in a secretarial capacity. Ihese officers made 106 special inspections under this Act during 1935-36 In addition inspections were carried out in the course of ordinary inspection and investigation work and while visiting factories, &c., in connection with other duties Complaints were received regarding 112 alleged breaches of the Act, while 161 other breaches were discovered by the Department's Inspectors, 217 warnings being issued There were 11 prosecutions during the year for various breaches of the Act and the orders made thereunder, convictions being entered in 9 of the cases, and penalties amounting to £17 bs ; being imposed. The year under review shows an improvement in the position, there being 1,292 new contracts registered. This would seem to indicate that with the increase of confidence in business employers are again prepared to engage apprentices. The sharp decline in the number of apprentices employed during the depression period and the consequent likelihood of a shortage of skilled tradesmen in the near future gives rise to a serious consideration of the desirability of encouraging employers to give suitable training to persons who by force of circumstances were prevented from serving a period of apprenticeship. ARREARS OF WAGES. Amounts totalling £11,790 10s. 2d. were collected by the Department's officers on behalf of workers who had been underpaid the wages prescribed by awards and the various Acts, while further amounts of such arrears, totalling £6,349 16s. 6d., were paid by employers, at the instance of the Inspectors, directly to the workers concerned: total, £18,14$ 6s. Bd. Increased inspection work during the year under review has resulted in a large increase in the above figures, the amount collected by the Department's officers being approximately twice as much as that collected in 1934-35. WORKERS' COMPENSATION ACT. During the year 110 cases were heard and determined by the Court of Arbitration (previous year, 111). The more important decisions, with a digest thereof, are published in " New Zealand Workers' Compensation Cases which is issued annually by the Department. SHEARERS' ACCOMMODATION ACT. Complaints were made last winter regarding the accommodation at a number of sheds. As a result a special inspection was made of those sheds to which the complainants drew attention, and alteration or improvements to the accommodation arranged for where necessary. It was decided towards the end of the year to fill the vacant position of Dominion Inspector of Accommodation at Sawmills, Flaxmills, and Shearing-sheds, and this officer recently commenced duty. A report of his activities will therefore be made next year. SCAFFOLDING AND EXCAVATION ACT. During the year 5,025 notices of intention to erect buildings and scaffoldings and to commence excavations were received (previous year, 3,413) and 12,971 inspections were made. There were 14 prosecutions, convictions being recorded in 12 cases, and fines amounting to £7 10s. being imposed. The number of accidents to workers during the year ending 31st December, 1935, was 229 (of which 1 was fatal). It should be mentioned that the total includes not only accidents to workers on scaffolding or in connection with gear or excavations, but also all other accidents occurring in connection with building operations. Taking into consideration the hazardous nature of the work and the number of workers involved, the number of accidents due to falls from scaffolds, ladders, or roofs is small—viz., 34. The numbers according to occupations were—labourers, 97; carpenters, 75; unclassified, 57. Information as to the time lost and compensation paid shows in regard to the cases in which details are available that a total of 6,391 days were lost and compensation to the amount of £3,968 was paid. The following are particulars of the fatal accident reported: — An employee of a brewery, engaged in whitewashing the ceiling of a ceikr, was standing on a 12 ft. by 2 ft. plank placed on top of two trestles about 10 ft. from the ground. In stepping down he caught his foot on the leg of the trestle and fell to the ground sufferingsevere head injuries which later proved fatal. In the following case the accident was to a person other than a " worker " within the meaning of that term as defined by the Workers' Compensation Act, 1922. A member of a firm of painters who had been working alone on a ladder at a height of 14 ft. from the ground fell and suffered fatal head injuries. It was thought that he may have come in contact with live electric wires, the resultant shock causing his fall.

Regulations under the Act were reviewed and brought up to date in November last. This was done after consultation with the employers' and workers' organizations concerned. In particular, safeguards necessary in connection with steel structural buildings and excavation work are provided for. In view of the hazardous nature of the work on buildings and excavation work special attention is given to this branch of the Department's activities. SERVANTS' REGISTRY OFFICES ACT. There are one hundred and seven offices registered in New Zealand (last year eighty-four). No prosecutions were necessary during the year for breach of this statute, and the offices appear to be satisfactorily conducted. RENT RESTRICTION. There were 183 applications from tenants for inquiry (previous year 120). The following table shows the results of the investigations (the figures in parentheses are those for the previous year) : —

As mentioned in previous reports, the Rent Restriction Continuance Act, 1927, provided that from the Ist May, 1928: (1) The standard rent shall be determined on the basis of 7 per cent, on the capital value of the dwellinghouse as at the date of such determination (instead of on the 1914 value) exclusive of rates, insurance, repairs, and depreciation (as before) ; (2) the Act shall cease to operate except where, on the application of the tenant, a Magistrate otherwise orders; in deciding the question the Magistrate shall have regard to the greater hardship that may be caused to either party concerned. Subject to the following paragraph, the provisions do not apply to houses first let after the 9th November, 1920. By the Rent Restriction Extension Act, 1931 (passed 31st July, 1931) the provisions were extended to cover dwellinghouses in the Hawke's Ray earthquake area let on the 3rd February, 1931 (the date of the earthquake), or since that date at a rental not exceeding £104 per annum. The provisions will expire on the 31st October, 1936, unless further extended. Provision for the restriction of increases in the rent of dwellinghouses and for the determination of fair rents is now made in the Pair Rents Act, 1936. FOOTWEAR REGULATION ACT. There were 2,313 inspections made throughout the Dominion under this Act. As most, if not all, of the footwear required to be branded under this Act is imported, the arrangement made with the Customs Department whereby all imported footwear is examined in the Customs shed before release is still being continued. The services of the Department's footwear Inspectors were again utilized in examining the boots supplied by the Unemployment Board to relief workers employed under the various unemployment schemes, with a view to ensuring that the manufacturers were complying with the Board's specifications. WEIGHTS AND MEASURES ACT. The regulations under the Act provide for the reverification of weights, measures, and weighing and measuring instruments in use for trade purposes. There were also submitted for verification 329,947 bottles—milk, cream, or oil. In addition to the reverification work referred to, the Department has carried out surprise tests of appliances on the owner's premises; the net-weight and standard-weight provisions of the regulations also receiving attention. There were 11 prosecutions for various breaches under this Act, convictions being obtained in nine cases, and fines amounting to £14 being imposed. Verification fees earned totalled £9,525 ss. 9d. (previous year, £9,041); increase, £484 ss. 9d. During the year the following twenty-eight new designs of weighing and measuring instruments were submitted under clause 4, Part 11, of the regulations, for approval for use for trade in the Dominion, viz.: — Weighing— Self-indicating (counter and platform) scales . . . . 13 Automatic weighing-instruments . . . . . . 2 Overhead track weighing-instrument .. . . .. 1 Measuring— Subdivided capacity measures .. .. .. 2 Flow-meters (petrol) . . . .. . . 5 Non-subdivided measures .. .. . . . . 4 Semi-automatic milk filling and measuring instrument .. .. 1 28 Of these, 18 have been approved after modification, 9 are still under consideration, and 1 has been rejected as not complying with the Weights and Measures Act and Regulations. Inspections were again made during the year to ensure that the provisions of the Sale of Food and Drugs Act relating to the weight of bread and the provisions of the AVeights and Measures Regulations relating to the sale of coal, coke, and firewood were being complied with, resulting in 3 prosecutions (all in respect of short-weight bread). These prosecutions are included in the figures given in the second paragraph above. LEAD PROCESS REGULATIONS. These regulations are framed to protect workers from the danger of lead poisoning in factories where lead paints are manufactured or prepared, and also in places where painting operations are carried on. Four cases of suspected lead poisoning were reported during the year, and in one case the portion of the factory dealing with lead process was condemned by the Health Department and new premises were constructed. The regulations are generally being well observed. Particular attention is being paid by Inspectors to the working conditions of employees in premises where spray guns are being operated. TAILORING TRADE REGULATIONS. These regulations were gazetted in 1925 to prevent the misuse of such expressions as " tailor made " and " hand made " as applied to garments/ made to measure, some of which a,re made partly by machine process. In several instances factory-made garments were found to be incorrectly described in advertisements and warnings were issued. Proceedings were not considered necessary. INTERNATIONAL LABOUR OFFICE. The nineteenth session of the International Labour Conference met on 4th June, 1935, New Zealand being represented by a delegation consisting of two Government representatives, one employers' representative, and one workers' representative. Reports of the delegation were presented last session while the draft conventions and recommendations adopted by the Conference will be tabled this session. These were:— 1. Draft Convention (No. 45) concerning the employment of women on underground work in mines of all kinds. 2. Draft Convention (No. 46) limiting hours of work in coal-mines (revised 1935). 3. Draft Convention (No. 47) concerning the reduction of hours of work to forty a week. 4. Draft Convention (No. 48) concerning the establishment of an international scheme for the maintenance of rights under invalidity, old-age, and widows' and orphans' insurance. 5. Recommendation (No. 45) concerning employment among young persons. 6. Draft Convention (No. 49) concerning the reduction of hours of work in glass-bottle works. In respect of the twentieth session a delegation from New Zealand has also been arranged, subjects for discussion being:— (i) The regulation of certain special systems of recruiting workers. (ii) Holidays with pay. (iii) Reduction of hours of work on public works undertaken or subsidized by Governments; in the building and civil engineering industry; in iron and steel works; in coal-mines; in the textile industry. (iv) Safety provisions for workers in building construction with reference to scaffolding and hoisting machinery, (v) Revision of Minimum Age Conventions by raising minimum age to fifteen years.

The twenty-first session will be a special maritime one and should open on the 6th October, 1936, the following being the items on the Agenda:— (i) (a) Regulation of hours of work on board ship. (6) Manning in conjunction with hours of work on board ship. (ii) Protection of seamen in case of sickness (including the treatment of seamen injured on board ship), i.e.— (a) The individual liability of the shipowner towards sick or injured seamen; and (5) Sickness insurance for seamen. (iii) Promotion of seamen's welfare in ports. (iv) Establishment by each maritime country of a minimum requirement of professional capacity in the case of captains, navigating and engineer officers in charge of watches on board merchant ships. (v) Holidays with pay for seamen. IMMIGRATION. In previous years this subject has been dealt with in a separate report. The total number of arrivals from the United Kingdom during the year ended 31st March, 1936, was! 653 (322 males and 331 females). Of this total none was assisted by the Imperial and New Zealand Governments. The activities of the Department have been in the direction of recovery of debts due in respect of passage-money loans of previous years, an amount of £701 10s. 4d. being still due to the New Zealand Government in this connection. Refunds due by migrants on account of non-fulfilment of the five years' residence condition also received attention. The effect of the policy of restriction in respect of assisted migration, which was first adopted in May, 1927, is illustrated by the figures hereunder, embracing the financial years 1926-27 to 1935-36 inclusive: —

There is increasing evidence of renewed interest both in New Zealand and in other parts of the British Empire in the subject of migration. Various plans have been suggested by organizations interested in the matter and the Department has endeavoured to obtain all available information that may be useful should the present policy be altered.
